Pocket Finance Terms of Use

The agreement

These terms are an agreement between you and Pocket Finance, LLC (“we”) for your use of the Pocket Finance app and the website pocketfinance.io. By downloading or using the app, you agree to them. If you don’t agree, please don’t use the app.

Our Privacy Policy explains how we handle information, and is part of these terms.

A planning tool, not financial advice

Pocket Finance is a tool to help you plan your own money. It is not financial, investment, tax, legal or credit advice, and we are not a bank, lender, financial adviser or credit counselor. Explanations in the app are general information about how the app works.

Everything the app shows comes from what you enter. Figures like “Yours to spend”, “Covered through”, payoff dates, interest and goal dates are estimates based on your plan. They are not your bank balance and may not match what actually happens. The app doesn’t connect to your bank and doesn’t know about purchases, fees, interest changes or payments you haven’t entered.

You’re responsible for your financial decisions and for checking important figures against your bank and lender statements. For advice about your situation, talk to a qualified professional.

Your data and backups

Your plan is stored only on your device. We never receive it, so we can’t recover, restore or repair it. You’re responsible for keeping backups, using the app’s Back Up feature or your phone’s own backups. We aren’t responsible for data lost because a device is lost, damaged, reset or replaced, the app is deleted, or a backup wasn’t made.

Your license to use the app

We give you a personal, non-transferable, non-exclusive license to use the app on Apple devices you own or control, for your own non-commercial use, as allowed by Apple’s Usage Rules. Pocket Finance, LLC keeps all rights in the app, its design, name, logo and content.

You agree not to copy, modify, resell or redistribute the app, reverse engineer it except where the law allows, or use it in a way that breaks the law.

Disclaimers and limits on liability

The app is provided “as is” and “as available”. To the fullest extent the law allows, we make no warranties of any kind, including that the app will be error-free, uninterrupted, accurate or fit for a particular purpose.

To the fullest extent the law allows, Pocket Finance, LLC won’t be liable for any indirect, incidental, special, consequential or punitive damages, or for lost money, missed or late payments, fees, interest, penalties, credit impacts or lost data, arising from your use of the app or reliance on anything it shows. Our total liability for any claim relating to the app is limited to the amount you paid for it, if any.

Some places don’t allow certain warranty exclusions or liability limits, so some of the above may not apply to you. Nothing in these terms limits rights you have under consumer law that can’t be waived.

Apple

These terms are between you and Pocket Finance, LLC only, not Apple. Apple isn’t responsible for the app or its content and has no obligation to provide maintenance or support for it. If the app fails to meet any warranty that applies, you may notify Apple, and Apple will refund the purchase price, if any. Beyond that, Apple has no warranty obligation for the app.

Pocket Finance, LLC, not Apple, is responsible for handling any claims about the app, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer protection claims, and claims that it infringes someone’s intellectual property.

You confirm you’re not located in a country subject to a U.S. government embargo or listed as a terrorist-supporting country, and you’re not on any U.S. government list of prohibited or restricted parties.

Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them against you.

Changes, ending and contact

Changes. We may update these terms. We’ll post the new version on this page with its effective date, and continuing to use the app means you accept it.

Ending. You can stop using the app at any time by deleting it. We may stop offering the app, or end your license if you break these terms.

Governing law. These terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to conflict-of-law rules, except where the law where you live requires otherwise.
